REsp n\u00b0. 1381832\/PR, estabeleceu os limites da aplica\u00e7\u00e3o do disposto no art. 3\u00ba, \u00a72\u00ba do Decreto-Lei n\u00b0. 911\/1969, que ap\u00f3s a altera\u00e7\u00e3o legislativa da Lei n\u00b0. 13.043\/2014, prev\u00ea a aplica\u00e7\u00e3o das regras relacionadas \u00e0 busca e apreens\u00e3o em contratos de aliena\u00e7\u00e3o fiduci\u00e1ria, tamb\u00e9m para o caso de reintegra\u00e7\u00e3o de posse referente \u00e0s opera\u00e7\u00f5es de arrendamento mercantil.<\/p>\n\n\n\n<p>A quest\u00e3o em debate era a possibilidade de purga\u00e7\u00e3o da mora nas opera\u00e7\u00f5es de arrendamento mercantil, diante da aus\u00eancia de previs\u00e3o de tal possibilidade, que era admitida pela jurisprud\u00eancia com base no art. 401 do C\u00f3digo Civil.<\/p>\n\n\n\n<p>A decis\u00e3o do Superior Tribunal de Justi\u00e7a estabeleceu que para os casos anteriores a 14\/11\/2014, data em que entrou em vigor a Lei n\u00b0. 13.045, \u00e9 admitida a purga\u00e7\u00e3o da mora, com o pagamento apenas da presta\u00e7\u00e3o em atraso, para as opera\u00e7\u00f5es de arrendamento mercantil.<\/p>\n\n\n\n<p>Ap\u00f3s a altera\u00e7\u00e3o legislativa, n\u00e3o h\u00e1 possibilidade de purga\u00e7\u00e3o da mora, mas apenas pagamento integral da d\u00edvida, segundo os valores apresentados na peti\u00e7\u00e3o inicial pelo credor, no prazo de cinco dias, hip\u00f3tese em que o bem ser\u00e1 restitu\u00eddo sem qualquer \u00f4nus ao devedor.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>por Cintia Luiza TondinO Superior Tribunal de
